Vallì Homemade di Valentina Tosi ("Vallì Homemade", "Vallì", "we", "us", "our"), with registered office at Vicolo San Domenico 20, 37122 Verona, Italy, VAT No. IT04942980238 – Tax Code TSOVNT86B62E897G, operates the Pasta Lovers House.

The Pasta Lovers House is Vallì Homemade’s international community dedicated to authentic Italian homemade pasta and is organised into two levels:

• Pasta Fam — a free community with introductory content, dedicated materials, community activities and communications relating to the Service;

• Pastatarian Club — a paid membership, available through the plans indicated at the time of purchase, which provides access to the Pasta Collection, members-only content, activities and other benefits described in the applicable offer.

  These Terms govern access to and use of the Pasta Fam and the Pastatarian Club, collectively referred to as the "Service".

Before registering or purchasing a subscription, users are invited to read these Terms carefully.

Acceptance of these Terms does not limit or exclude any mandatory rights granted to consumers under applicable law.

1. Eligibility, registration and account

a. Age requirements

To independently create a Pasta Fam account or subscribe to the Pastatarian Club, users must be at least 18 years old or have reached the age of majority required by the laws of their country, if higher.

The Service is intended for individuals for personal, non-commercial use, unless otherwise agreed in writing with Vallì Homemade.

b. Account creation

To use the Service, users must provide accurate and up-to-date information, including a valid email address.

Users are responsible for keeping their login credentials confidential and for activities carried out through their account, except for unauthorised use not attributable to the user.

c. One account, one user

Digital access to the Pasta Fam and the Pastatarian Club is personal and may not be shared with third parties.

Users are of course free to teach family members and loved ones what they have learned, make pasta together with them and share the final result.

During Cook-Along LIVE sessions only, a Pastatarian Club member may participate together with family members who permanently live in the same household, so they can cook and enjoy the experience together. This does not create additional accounts or give those persons the right to independently access the Pastatarian Club’s members-only Content.

If any household member wishes to independently access the Pastatarian Club’s members-only Content or participate in other LIVE sessions, they must activate their own personal subscription.

It is not permitted to share the following with persons who do not have their own account:

• username or password;

• access to the platform;

• video lessons;

• members-only PDFs and technical sheets;

• recordings of live sessions;

• other protected digital materials.

Knowledge is meant to be passed on, subscriptions are not — and a Cook-Along is even better when you cook together.

d. Unauthorised access

Users must notify Vallì Homemade without undue delay if they become aware of any unauthorised use of their account.

Vallì Homemade may take reasonable security measures, including temporarily suspending an account, when necessary to protect the user, other members or the Service.

e. Service communications

Communications necessary for the management of the Service may be sent:

• by email;

• through platform notifications;

• through communications within the community.

Such communications may include, for example, information relating to the account, payments, renewals, changes to the Service, security, live sessions, content availability and other matters directly connected with the membership.

Promotional and marketing communications are managed separately in accordance with the Privacy Policy and applicable law.

2. Pasta Fam — free level

a. Registration

Registration for the Pasta Fam is free of charge.

During registration, users may be asked to provide information necessary to create and personalise their account, such as name, email address, country and, where applicable, pasta-related preferences.

Registering for the Pasta Fam does not create any obligation to purchase the Pastatarian Club.

b. Communications

Registration allows Vallì Homemade to send communications necessary for the operation of and participation in the Pasta Fam. Marketing communications will be sent in accordance with the applicable legal bases and any consents required under applicable law.

c. The Kitchen Rules — Code of Conduct

The Pasta Fam is our virtual family: a space dedicated to pasta, sharing and learning.

Each member agrees to:

We welcome different questions, experiences and journeys without judgement, discrimination, harassment or personal attacks.

💛 Share and inspire
Successful dishes, experiments, small victories and even "pasta fails" are welcome when they contribute positively to the community.

💛 Stay on topic
The community is mainly dedicated to the world of pasta and closely related topics.

💛 Avoid spam and unauthorised promotions
Spam, advertising, commercial self-promotion or unsolicited promotional links are not permitted without authorisation.

💛 Respect rights and people
Users may not post unlawful, defamatory or offensive content, or content that infringes privacy, intellectual property rights or other third-party rights.

d. Moderation

In the event of a breach of the Kitchen Rules or applicable law, Vallì Homemade may:

• remove content or restrict its visibility;

• ask the user to change their behaviour;

• temporarily suspend the account;

• in the most serious or repeated cases, terminate access to the community.

Where reasonably possible, measures will be proportionate to the nature and seriousness of the breach.

e. Nature of the free service

Pasta Fam is free of charge. Vallì Homemade may modify its content, features or structure and, if necessary, suspend or discontinue the free level. Where a modification or discontinuation may significantly affect users, Vallì Homemade will seek to provide reasonable advance notice, except where prevented by security reasons, legal obligations, technical urgency or similar circumstances.

3. Pastatarian Club — subscription

a. Nature of the Club

Pastatarian Club is a paid digital membership that may include, depending on the offer in force:

• video lessons;

• recipes and technical sheets;

• Pasta Collection;

• downloadable materials;

• live Cook-Along sessions;

• live Fundamentals and Q&A sessions;

• replays;

• community;

• updates and new content;

• other services or benefits indicated on the sales page.

The Club therefore includes both digital content and ongoing digital services.

b. Price and selected plan

Before purchase, the following information will be clearly indicated:

• price;

• any applicable taxes;

• billing frequency;

• duration of the billing period;

• automatic renewal;

• cancellation methods;

• any promotional conditions.

The plan may be monthly, annual or another plan expressly indicated in the relevant offer.

c. Automatic renewal

Unless otherwise stated in the offer, the subscription automatically renews for the period indicated at the time of purchase until cancelled by the user.

The payment will be charged to the selected payment method.

Vallì Homemade will provide the information and any renewal notices required under applicable law.

Where Article 65-bis of the Italian Consumer Code applies, Vallì Homemade will send the notice required by law at least 30 days before expiry in the cases to which that provision applies.

Any greater mandatory rights relating to advance notice, renewal reminders or cancellation under the law of the consumer’s country remain unaffected.

d. Cancellation

Users may disable automatic renewal at any time before the next renewal through the options made available in their account, by following the instructions provided on the platform, or by contacting: [email protected]

The cancellation procedure will not be made unreasonably more difficult than the subscription procedure.

Unless otherwise provided by law, cancellation stops future renewals and access will remain available until the end of the period already paid for.

e. Promotional prices and Founder / Price Locked

Some members may benefit from special promotional conditions, including Founder or Price Locked pricing.

Where a promotion expressly states that the price will remain locked for as long as the subscription remains active and payments remain up to date, Vallì Homemade will honour that condition in accordance with what was communicated at the time of subscription.

In the event of voluntary cancellation followed by a later re-subscription, the user will not automatically be entitled to the previous promotional price unless otherwise stated.

In the event of failed payment, Vallì Homemade may suspend access after the reasonable payment attempts provided for by the system have been made.

Any permanent loss of a promotional rate will be applied only in accordance with the specific conditions communicated for that promotion and with applicable law.

f. Changes to standard prices

Vallì Homemade may change the price of standard subscriptions for future billing periods.

Price changes will be communicated before they take effect with the notice required by applicable law and, in any event, with at least 30 days’ notice where possible.

The change will not affect any period already paid for.

Before the new price becomes applicable, users may prevent the next renewal by cancelling the subscription.

Rates expressly guaranteed as Price Locked remain governed by the conditions of the relevant promotion.

g. Voluntary 24-hour satisfaction guarantee

Regardless of any mandatory rights provided by law, Vallì Homemade voluntarily offers a:

24-Hour Satisfaction Guarantee A new member may request a refund of the first payment within 24 hours of their first Pastatarian Club subscription by writing to: [email protected] unless more favourable promotional conditions have expressly been communicated.

This commercial guarantee is additional to, and does not replace or limit, any rights granted to consumers by law.

h. Statutory right of withdrawal

Where provided by applicable law, consumers have the right to withdraw from the contract within the period established by law without having to provide a reason. For consumers subject to Italian and European Union law, the ordinary period is 14 days from the conclusion of the contract, subject to exceptions provided by law.

Because the Pastatarian Club includes digital content and digital services made available immediately after purchase, commencement of supply during the withdrawal period will be handled in accordance with the requirements of applicable law.

Where the law provides for the loss of the right of withdrawal in relation to digital content supplied immediately, such loss will occur only where all legally required conditions have been met, including, where applicable:

1. the consumer’s express consent to begin supply before expiry of the withdrawal period;

2. the consumer’s express acknowledgement that this results in loss of the right of withdrawal;

3. any confirmation required by law.

General acceptance of these Terms does not replace any separate express consent required by law.

Where the contract includes services for which an independent right of withdrawal or refund remains available, the mandatory rights provided by law continue to apply.

i. Standard refunds

Except in connection with:

• the 24-Hour Satisfaction Guarantee;

• the statutory right of withdrawal;

• remedies for lack of conformity;

• modifications or termination of the Service that give rise to a right to a refund;

• any other mandatory right provided by law,

payments relating to subscription periods that have already begun are not normally refundable on a pro-rata basis. This provision does not limit any mandatory consumer rights.

j. Failed payment

If a payment fails, Vallì Homemade may:

• make further attempts to charge the payment;

• request an updated payment method;

• temporarily suspend access to the Club.

Access may be restored once payment has been regularised.

4. Conformity of digital content and digital services

Vallì Homemade will provide the Pastatarian Club’s digital content and services in accordance with what was promised in the offer and in compliance with applicable mandatory rights.

Accordingly, where applicable, consumers retain their rights relating to:

• conformity of digital content or services;

• functionality;

• promised quality and characteristics;

• accessibility of the Service;

• necessary updates;

• restoration of conformity;

• price reduction;

• termination of the contract;

• refunds where provided by law.

Nothing in these Terms excludes or limits such remedies where they are mandatory.

5. Vallì Homemade Content and intellectual property

a. Ownership

Videos, photographs, texts, PDFs, technical sheets, graphics, editorial recipes, educational materials, recordings, trademarks, logos, layouts and other content created or made available by Vallì Homemade remain protected by applicable intellectual property rights.

Purchasing a subscription does not transfer to the user any ownership rights in such materials.

b. Personal licence

Users are granted a limited, personal, non-exclusive, non-transferable and non-sublicensable right to use Content to which they lawfully have access for personal and non-commercial purposes.

c. Prohibited uses

Unless authorised in writing or otherwise permitted by mandatory law, users may not:

• resell or distribute Vallì Homemade materials;

• publish members-only PDFs, technical sheets or videos in full;

• share recordings of lessons or live sessions;

• use the materials as content for their own courses or commercial training;

• remove watermarks or protection systems;

• carry out scraping, automated acquisition or unauthorised mass downloading;

• substantially reproduce or adapt Vallì Homemade educational materials for distribution to third parties.

d. What you may do

These restrictions do not prevent users from:

• preparing the recipes for themselves, their friends and family;

• experimenting in the kitchen;

• cooking together with friends and family;

• posting photographs of their own pasta;

• sharing their personal experience.

6. Content posted by members

Users retain the rights to original content they post in the community, such as photographs, texts and comments.

By posting content within the Pasta Lovers House, users grant Vallì Homemade a non-exclusive licence solely to the extent necessary to:

• host it;

• display it within the community;

• technically reproduce it for operation of the Service;

• moderate it;

• make it available to other members in accordance with the community’s features.

This licence ends when the content is deleted, except for temporary technical copies, legal obligations or content already lawfully incorporated into conversations or interactions with other users.

Posting content within the community does not automatically authorise Vallì Homemade to use a user’s photographs or testimonials in advertising, advertisements or external promotional campaigns.

For such uses, separate consent or authorisation will be requested where necessary.

Users represent that they have the right to post the uploaded content and that it does not infringe third-party rights.

7. Operation and modification of the Service

a. Devices and connection

To use the Service, users must have:

• a compatible device;

• an adequate internet connection;

• compatible software or browsers where required.

b. Platform

The Service may use third-party platforms or technology providers.

The terms and privacy notices of those providers may apply to their services to the relevant extent.

c. Language

Unless otherwise indicated, Service content is primarily available in English.

d. Evolution of content

The Pastatarian Club is a dynamic service. Individual content, recipes, formats, tools and teaching methods may be updated, replaced or reorganised over time in order to maintain and improve the Service. Vallì Homemade will not arbitrarily modify essential features of an already-paid subscription in a way that substantially reduces its value without respecting any rights granted to consumers.

e. Live sessions

Dates and programmes of live sessions may change for technical, organisational, personal or force majeure reasons. If an announced live session cannot take place, Vallì Homemade will make reasonable efforts to reschedule it or provide an equivalent solution.

f. Technical interruptions

Maintenance, updates, internet outages, failures of third-party providers or events outside Vallì Homemade’s reasonable control may cause temporary unavailability. Vallì Homemade will make reasonable efforts to restore the Service. Applicable statutory rights remain unaffected where the unavailability constitutes a material lack of conformity.

8. Privacy and communications

Vallì Homemade di Valentina Tosi is the data controller for the processing of personal data carried out for its own purposes.

The processing of personal data is governed by the Privacy Policy, which is a separate document from these Terms.

Personal data may be processed, in accordance with the applicable legal basis, for purposes including:

• account creation and management;

• provision of the Service;

• billing and payments;

• security;

• customer support;

• management of live sessions and the community;

• compliance with legal obligations;

• permitted personalisation;

• promotional communications where permitted by law.

Where consent is required, it will be requested separately and may be withdrawn in accordance with the methods described in the Privacy Policy.

9. Suspension and termination of the account

a. Breaches

Vallì Homemade may take proportionate measures in relation to an account where the user:

• seriously or repeatedly breaches these Terms;

• uses the Service fraudulently;

• infringes intellectual property rights;

• compromises the security of the Service;

• harasses other members;

• uses the Service for unlawful activities.

Except in serious, urgent situations or where legally prevented from doing so, Vallì Homemade will seek to inform the user of the reasons for the measure taken.

b. Effects of subscription cancellation

Simply disabling automatic renewal does not normally terminate access immediately: the user retains access to the Club until the end of the period already paid for.

c. Materials already downloaded

Materials that Vallì Homemade has expressly made downloadable and that the user has already lawfully saved to their device will not technically be deleted from that device at the end of the subscription. Their use remains subject to the intellectual property restrictions set out in these Terms.

10. Health, allergies and use of recipes

The content of the Pasta Lovers House is provided for culinary, informational, educational and entertainment purposes.

It does not constitute personalised medical, nutritional, healthcare or dietary advice.

Descriptions such as "gluten-free", "dairy-free", "vegan" or similar refer to the ingredients and methods used in the relevant recipe context and do not replace an individual assessment of allergies, intolerances or medical conditions.

Users are responsible for checking:

• purchased ingredients;

• labels;

• cross-contamination;

• allergens;

• compatibility of recipes with their own needs.

This provision does not exclude any liability that cannot lawfully be excluded.

11. Limitation of liability

Nothing in these Terms limits or excludes liability that cannot lawfully be excluded or limited.

To the extent permitted by applicable law, Vallì Homemade will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was concluded or that result from circumstances outside Vallì Homemade’s reasonable control.

Any limitations contained in these Terms do not affect mandatory consumer rights.

12. Changes to these Terms

Vallì Homemade may periodically update these Terms for:

• legislative or regulatory changes;

• security requirements;

• introduction of new features;

• reasonable evolution of the Service;

• clarifications or corrections.

Changes that are purely favourable, technical or non-material may take effect upon publication of the updated version. Where a change materially affects a subscriber’s rights or obligations, Vallì Homemade will provide reasonable advance notice and recognise any cancellation or refund rights required by applicable law.

13. Applicable law and international consumers

These Terms are governed by Italian law.

However, this choice does not deprive consumers of any mandatory protections granted by the law that would apply in the absence of such choice. In particular, where Vallì Homemade directs its commercial activities towards consumers residing in other countries, any mandatory rights granted by the applicable local law remain unaffected, including, where applicable, rights relating to:

• pre-contractual information;

• automatic renewals;

• cancellation;

• cooling-off periods;

• refunds;

• guarantees relating to digital services;

• commercial practices;

• data protection.

Nothing in these Terms shall be interpreted as an advance waiver of any right that applicable law classifies as mandatory.

14. Jurisdiction

For disputes involving consumers, the mandatory rules on jurisdiction and territorial competence provided by applicable law shall apply. Accordingly, where required by law, consumers may bring proceedings before the competent court of their place of residence or domicile.

Only in relationships where mandatory consumer-protection jurisdiction rules do not apply shall the Courts of Verona have jurisdiction, unless otherwise validly agreed between the parties.

15. Alternative dispute resolution

Consumers may have the right to use alternative dispute resolution (ADR) procedures provided under applicable law. Vallì Homemade will provide, where required by law or relevant to the dispute, information concerning the applicable ADR bodies.

16. Final provisions

a. Severability

If any provision of these Terms is declared invalid, ineffective or unenforceable, the remaining provisions will continue to have effect to the extent permitted by law.

b. Failure to exercise a right

Failure by Vallì Homemade to exercise any right does not constitute a permanent waiver of that right.

c. Assignment

Vallì Homemade may transfer the contract or certain rights and obligations to another party as part of a reorganisation, sale or transfer of the business, provided that such transfer does not reduce the user’s mandatory rights. The user’s contractual rights remain protected.

d. Entire agreement

These Terms, together with any specific commercial conditions communicated at the time of purchase and any other documents referred to where applicable, govern the relationship relating to the Service.

Where more favourable specific promotional conditions were communicated at the time of purchase, they prevail over the corresponding general provision to the extent expressly stated.

e. Language

These Terms may be made available in more than one language. The Italian version constitutes the reference version, provided that this does not reduce any mandatory language rights granted to consumers under applicable law.
